In an important development for overseas Pakistanis, the Islamabad High Court has ruled that a complaint under the Illegal Dispossession Act 2005 filed through a special attorney is maintainable.
The Sessions Judge-III, Islamabad (East) had previously dismissed a complaint filed through a special attorney on the grounds that a valid complaint under the Illegal Dispossession Act 2005 can only be filed by the aggrieved person himself. The decision however has been overturned by the Islamabad High Court in an appeal successfully argued by Usman Jillani.
This development is important for overseas Pakistanis who are unable to travel to Pakistan and can now initiate litigation, including criminal action, through a special attorney based in Pakistan.
Islamabad-based Usman Jillani and Fatima Midrar represented the client before the High Court.
