NEPRA Appellate Tribunal grants interim injunction in favour of QATPL suspending recovery of fine

On 27 March 2023, ABS & Co secured an interim injunction suspending the recovery of a fine amounting to PKR 20 million imposed by NEPRA on Quaid-e-Azam Thermal Power (Private) Limited (QATPL). The injunction was granted by the NEPRA Appellate Tribunal.

As a consequence of the power system breakdown in the country on 9 January 2021 leading to a blackout of the national grid, various Independent Power Producers were fined by NEPRA for delay in synchronization of their plants after the blackout as an alleged violation of Section 14(b)(4) of the NEPRA Act. In this regard, QATPL, a public sector company operating an RLNG power generation facility of 1180 MW at Bhikki, District Sheikhupura was fined by NEPRA to the tune of PKR 20 million for an alleged delay of approximately 13 hours in synching its units with the national grid.

QATPL, represented by ABS & Co, challenged this fine before the NEPRA Appellate Tribunal and ABS & Co successfully obtained an interim injunction from the NEPRA Appellate Tribunal suspending the recovery of the fine. The matter is currently ongoing.
