ABS & Co is pleased to announce its appointment as counsel to Guarantee Engineers in a major contractual dispute concerning the Recep Tayyip Erdogan Hospital Expansion Project, Muzaffargarh – a high-profile healthcare infrastructure project developed under the Infrastructure Development Authority of Punjab (IDAP).
The contract is governed by the FIDIC 1999 Red Book, and the matter is currently pending before a two-member arbitral tribunal. Disputes involve complex issues such as the valuation of Variation Orders, alleged unilateral reduction in overheads and profit, and procurement of items outside the agreed scope of work. One major dispute between the parties is concerning the application of MRS rates of the Government of Punjab and how those rates are to be used, if at all, for determining rates of non-BOQ items
